RETURN AND EXCHANGE

This section illustrates the methods and conditions for exercising the right of withdrawal and for requesting the exchange of goods.

1. RIGHT OF WITHDRAWAL

The CLIENT, as a consumer, has the right to withdraw from the Product sales contract, as established by art. 52 of Legislative Decree n. 206/2005 (Consumer Code), without any explanation and without incurring any penalty within fourteen (14) days from the date on which he received the products purchased on WWW.ISABELLEBLANCHE.COM.

In accordance with art. 54 of the Consumer Code, the CLIENT can exercise the right to withdraw by using one of the following methods:

- sending by registered mail to the Vendor (customer@isabelleblanche.it) the return form downloadable from WWW.ISABELLEBLANCHE.COM website link and compliant with the standard form pursuant to art. 49, paragraph 4 of the Consumer Code, to be completed in full;

- sending by post to the Vendor another explicit declaration of the decision to withdraw from the contract within fourteen (14) days of receipt of the products.

The return form must be sent to the attention of the Customer Service at the registered office of IMODA SRL Via Bruges 50/52 59100 Prato.

The CLIENT will be responsible for proving the correct and timely exercise of the right of withdrawal.

In the withdrawal notice, the CLIENT must specify the Products for which he intends to exercise the withdrawal.
Once he has exercised his right to withdraw, the CLIENT must return the Products without undue delay and in any event not later than fourteen (14) days after the day on which he notified the Vendor of his decision to withdraw by sending the aforementioned products to the following address, indicated in the model Instructions on the right of withdrawal to IMODA SRL Via Bruges 50/52 59100 Prato.

2. CONDITIONS FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL IN COMPLIANCE WITH ART. 52 OF THE CONSUMER CODE

The right of withdrawal is exercised correctly if the following conditions are fully respected:

- the right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products;

- products security thread and identification tag must not be cut or broken, because they are considered as an integral part of the good;

- each product must be returned with all the labels and tags attached, and inclusive of all the original packaging and accessories (dust bags, hangers, clothes covers, etc.) received together with the order;

- products must not have been used, worn, washed;

- returned products must be delivered to the shipper within fourteen (14) days from when the decision to withdraw from the contract was communicated to the Vendor.

If the CLIENT has complied with all the required conditions, the Vendor, in accordance with art. 56 of the Consumer Code, will fully reimburse the price of the products purchased, but the return costs will be borne by the User, unless the Vendor has expressly exempted the CLIENT from them at the time of purchase, and at the specific condition that the CLIENT makes use of the forwarder and the shipping methods suggested by the Vendor in the following paragraph.

3. IDENTIFICATION TAG OF THE PRODUCT

All products offered for sale by the Vendor are provided with an identification tag attached with a disposable seal, which is an integral part of the good. The items must be tried on without removing the tag and its seal, because otherwise returned products that do not have one will not be accepted.

4. METHODS OF RETURNING THE PRODUCTS TO THE VENDOR - UPS

The Vendor recommends to use the courier UPS (www.ups.com) for returning the purchased products.
If the CLIENT can use UPS for the shipping and the pre-printed label – which carries the return address – enclosed in the original order, he will not have to pay the return costs. Indeed, the Vendor will pay the UPS courier and will deduct from the refund a fee which is equal to the cost incurred for delivering the purchased products to the User’s home. Contact UPS to organize a return to the following link - UPS - . Moreover, this shipping method gives the possibility of tracking each package sent at any time relieving the User from any responsibility for loss or damage to the products during transit. Instead, if the CLIENT decides to return products using a courier other than UPS, he will have to pay the return shipping costs and will be responsible for any loss or damage to the products during transport.
It is understood that, in this event, the Client will also be refunded an amount equal to the standard shipping cost of the purchased products, although, in accordance with art. 56, paragraph 2, of the Consumer Code, he will not be refunded for any additional costs incurred due to choosing another kind of shipment and delivery that is different to/or faster than the standard method.

5. EXCLUSION OF THE RIGHT OF WITHDRAWAL AND CONFORMITY CHECKS OF THE RETURNED PRODUCTS

Please find below the provisions of the Sale Conditions regarding the exclusion of the right of withdrawal and the conformity of the returned products.
In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that the CLIENT has purchased customized or personalized packaged products or sealed goods that cannot be returned for health reasons and have been opened after delivery.

If the methods and terms for exercising the right of withdrawal specified below are not respected:
- the right of withdrawal must be regularly exercised fourteen (14) days of receipt of the products;
- returned products must be delivered to the shipper within fourteen (14) days from when the decision to withdraw from the contract was communicated to the Vendor;
- the products must not be damaged;
In the hypothesis referred to in art. 59 of the Consumer Code the CLIENT will not be entitled to a refund of the amounts already paid to IMODA SRL
IMODA SRL will notify the CLIENT by e-mail of the non-acceptance of the return. Within fourteen (14) days of receipt of the email sent by IMODA SRL the CLIENT may choose to obtain, at his own expense, the products in the state in which they were returned to the Vendor by giving him notice about it, following the dispositions that will be communicated.
Otherwise, the Vendor may retain the products, in addition to the amounts already paid for their purchase.

If the methods and terms for exercising the right of withdrawal specified below are not respected:

- the products must not have been used, worn, washed;
- the identification tag must still be attached to the products with the disposable seal which forms an integral part of the good;
- the products must be returned in their original packaging (if you want to return a kit, you must return all the items that make it up);
- the products must not be damaged;
The CLIENT will not be entitled to a full refund of the amounts already paid to Imoda s.r.l.. In accordance with art. 57, paragraph 2, of the Consumer Code, the Client will, in fact, be responsible for the decrease in value of the returned products, resulting from a use other than that necessary in order to allow the CLIENT to ascertain the nature, characteristics and functioning of the products themselves. In this case, a percentage equal to the estimated value decrease of the products and in any case between ten (10) and ninety (90) percent of the sums paid by the CLIENT to the Vendor for the purchase of the returned products will be deducted from the expected refund, as will be specifically communicated, through e-mail, by IMODA SRL . Within fourteen (14) days from sending the e-mail with which the CLIENT will be informed about the sum deducted from the refund, he can choose to get back, at his expense, the products in the state in which they were returned to Imoda s.r.l. by giving notice about it, following the dispositions that will be communicated to the CLIENT. Otherwise, IMODA SRL may retain the products and an amount corresponding to the percentage deducted on the refund.
IMODA SRL assumes no responsibility for products returned by mistake or for objects forgotten in packages or products returned.

6. TIMES AND METHODS OF REFUND

After verifying the correct exercise of the right of withdrawal and the returned products, IMODA SRL will refund the amount of the products subject to withdrawal within a maximum period of fourteen (14) days, including any shipping costs.
As required by art. 56 paragraph 3 of Legislative Decree 206/2005, modified by Legislative Decree 21/2014, IMODA SRL can suspend the refund until receipt of the goods or until the CLIENT demonstrates that he has sent the goods back to IMODA SRL
IMODA SRL will perform reimbursement using the same payment method chosen by the CLIENT during the purchase.

7. EXCHANGE POLICY

The CLIENT will have the possibility to change the purchased products under the following conditions:

- change of the same model, but in a different size and/or color;

- the change can be made only if the products in the selected size and/or color are available in the warehouses of the Vendor;

- the CLIENT may request the exchange of one or more products purchased no later than fourteen (14) days from the date of their delivery, by filling in the Return From, to be sent electronically within the aforementioned term;
-the products to be changed must be delivered to the courier within fourteen (14) days starting from when the decision to change the products was communicated to the Vendor;

- the CLIENT may only submit a single replacement request for each product purchased;

- the products for which the CLIENT requests the replacement must be returned with their original packaging, not used, worn, washed or damaged, and they must still have their identification tag attached with the disposable seal.

If all the above conditions are correctly fulfilled, once you have filled in and transmitted the Return Form containing your request for an exchange, the Vendor will acknowledge the request by sending an e-mail to the CLIENT.

If the selected products are available in the warehouse, the Vendor can accept the request for an exchange and will send an e-mail confirming the shipment of the replacement items. In this case the shipment will occur within thirty (30) working days from the date on which the Vendor will be made aware of the request of exchange made by the Client. The costs for shipping the replacement products will be borne by the Vendor.

If the selected replacement product(s) are not available in the warehouse, the Vendor will not be able to accept the request for exchange and will refund the CLIENT for the product(s) originally purchased and not replaceable, in accordance with the provisions of the Consumer Code and in the manner provided above. IMODA SRL will reimburse using the same payment method chosen by the CLIENT during the purchase phase.

8. CONSUMER CODE

These Conditions for exercising the right of withdrawal, which form an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
